Construction General Permit (CGP)

The Department of Environmental Quality (DEQ) completed its final 401 Certification on April 3, 2012. The Final 2012 Construction General Permit became available in Idaho on April 9, 2012. ITD created a CGP Guide to help illustrate the requirements of the 2012 permit and the changes between the 2008 and 2012 permits.

Previous coverage under the EPA's Final 2008 Construction General Permit (CGP) is required for Idaho Transportation Department (ITD) construction activities that disturb greater than one acre of soil and have the potential to discharge stormwater to waters of the U.S. All existing projects under the 2008 permit require coverage under the 2012 permit by July 8, 2012.

Inspections

ITD shall conduct inspections per the CGP using form ITD-2802. ITD inspection procedures are defined in the instructions of the ITD-2802 form. All certified ITD-2802 forms should be sent to: HQ.ENVSWPP@itd.idaho.gov

Consent Decree

A Consent Decree (CD) signed in 2006 between ITD and the EPA was terminated on August 1, 2011. The CD included additional training, inspection, construction, and reporting requirements for ITD construction projects that were above and beyond those required by the CGP.
